Refers to organizations that have entered into an agreement with EkRewards to use our Services for their employee rewards and recognition programs.
Means individuals who access and use our Services through their employer's Customer Company account.
Includes all information, data, text, graphics, photos, profiles, audio, video, and other materials that are posted, stored, or transmitted through our Services.
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age.
To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
For Customer Companies, the organization is responsible for all activities conducted through its account and for ensuring that all Employee Users comply with these Terms.

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by EkRewards, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The EkRewards name, the EkRewards logo, and all related names, logos, product and service names, designs, and slogans are trademarks of EkRewards or its affiliates or licensors. You must not use such marks without the prior written permission of EkRewards.
By posting, storing, or transmitting any content on or through the Services, you grant EkRewards a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, and display such content in connection with providing the Services.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL EKREWARDS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts located in Mumbai, India. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter.
